Child Adoption: Due to Temple of Healing effort Adoption Process Becoming Easier. The process of adopting children in India has become simpler, thanks to a PIL filed by Temple of Healing in the Supreme Court in August 2021.
Dr. Piyaush Saxena, a representative of the organization, told reporters that the PIL aimed to simplify and make the adoption process more accessible. The Supreme Court took cognizance of the PIL and, after more than 12 hearings, issued orders that have eased the previously complicated process.
The Supreme Court asked the central and state governments to respond. The court stated that making young couples wait three to four years to adopt a child is unacceptable and that the process needs to be corrected. The court also clarified that the Hindu Adoption and Maintenance Act is not affected by the Juvenile Justice Act 2015, Section 56(3), and Adoption Regulations 2022.
According to Dr. Saxena, this development makes it much easier for people to adopt children. As a result, the court has instructed the appointment of adoption agencies in all 760 districts across the country. He added that despite strict laws, 135,000 children are adopted annually in the United States, whereas in India, only around 4,000 children are adopted each year due to the complicated process.
There are 31 million orphaned children in India, while over 25 million couples are eager to have children. Every child has the right to a family, and our PIL has bridged this gap. This step has brought hope to millions of orphaned children and childless couples waiting for a better future.
Several states have also begun re-examining their adoption policies. Since August 20 this year, unmarried, widowed, ¹divorced, or legally separated individuals between 35 and 60 years old have been allowed to adopt children.
Dr. Saxena stated that the simplification and digitization of the adoption process will put an end to lengthy and complicated procedures. Increased transparency will also lead to a centralized digital database for adoptable children and prospective parents, dispelling societal misconceptions about adoption. The issue has sparked intense discussion in the media and society, raising hopes for positive change.
Moving forward, their organization will work to ensure unbiased adoption rights for unmarried, LGBTQ+, and other communities. Adoption is not just a legal process; it’s a social responsibility.
